19. Unfinished Structures

If the shell of the home or “obra negra” has not been completed and no significant construction has been done for a three-month or longer period, the Administrators may recommend the following:

If the structure is deemed unstable or irreparable by an engineer retained by the Administrators, the Administrators may recommend to the Master Assembly and to the Subregime within which the site is located that the structure be demolished. If the recommendation is approved by the Master Assembly and the Subregime Surveillance Committee, the Owner shall be given 90 days to complete the demolition of any structure on the lot and to restore the lot to a safe and environmentally and aesthetically acceptable condition. If the Owner fails to demolish the structure and restore the lot, then the Administrators may proceed with such work and the cost for such work shall be paid for by the Owner.

If the structure is deemed sound by the engineer but is unfinished, the Administrators may recommend and the Master Assembly and the affected Subregime Surveillance Committee may require an acceptable exterior finish or that the entire site be enclosed with a finished plaster and painted wall. The exterior or wall must be maintained in good repair by the Owner. The Owner will be given 90 days to complete the work. If the Owner fails to complete the work, the Administrators may proceed with such work at the expense of the Owner. 

Unfinished structures may not be used for long term storage or as a construction work yard without specific approval, subject to appropriate conditions, from the Administrators and the Subregime Surveillance Committee for the Subregime within which the home is located.
