12. Sanctions

12.1. Authority for Sanctions. The Master Assembly or Administrators may impose one or more sanctions pursuant to the Master Rules, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly, upon an Owner who fails to comply with any obligation under the Master Rules, the Master Condominium Declarations, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly. In addition, Administrators may, without previous resolution of the Master Condominium Assembly or the Master Surveillance Committee, initiate legal action to recover any past due Assessments as provided in these Master Rules. Under no circumstances, however, may Administrators deny the Owner or Sub-Condominium Owner access to their Private Unit or Sub-Condominium Unit.

12.2. Procedures for Imposition of Sanctions. Except as otherwise specifically provided for in the Master Rules or the Law, Administrators may establish sanctions for violations of the Master Rules, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly. Unless otherwise specifically provided in the Master Rules or the Law, Administrators must follow procedures for the imposition of sanctions established in the Administrators Rules, which must be based on principles of fairness and due process. Such procedures and sanctions must be approved by the Ordinary Master Condominium Assembly and set forth in the Administrators Rules. Where no sanction has been set forth in the Master Rules, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly for a particular offense, Administrators must obtain the approval of the Master Condominium Assembly prior to imposing a sanction.

12.3 Arbitration. Administrators must establish procedures for arbitration by an independent third party or panel to resolve conflicts that may arise concerning Owners or Administrators in the interpretation and application of the Law or the Master Rules, the Master Condominium Declarations, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly.

12.4 Sale. In the event an Owner repeatedly fails to comply with their obligations under the Master Rules, the Master Condominium Declarations, the Administrators Rules, the Design Guidelines, or any other applicable rule, regulation, standard, resolution, or guideline issued by the Master Condominium Assembly, Administrators may, subject to the approval of a simple majority of the Ordinary Master Condominium Assembly, file a lawsuit to cause the sale of a Private Unit or Sub-Condominium Unit in public auction, and the Owner is responsible for any judgment, costs, and attorneys' fees ordered by the Court. Such actions by Administrators require the approval of an Extraordinary Master Condominium Assembly in accordance with the Law and these Master Rules.

12.5 Non-payment of Assessments; Stopping Common Services. In addition to any other remedies established in the Master Rules and the Law, if any Owner defaults on their obligation to pay any assessment, Administrators are entitled to suspend any common services other than water, which cannot be suspended but which can be reduced to a minimum.

12.6 Stopping Construction. In the case of construction upon or improvements to Private Units or Sub-Condominium Units, if the Owner is in violation of any of the Design Guidelines, requirements of the Design Review Committee, the Master Rules, Administrators Rules, or lawful directives of Administrators, Administrators are entitled to stop related construction over a Private Unit or Sub-Condominium Unit and deny access to and stop related construction personnel and traffic in any and all common areas of the Master Condominium and Sub- Condominiums.
